Divorce

Collaborative Divorce Success

Not every divorce requires lengthy litigation. In this collaborative divorce matter, the parties were committed to resolving disputes constructively and worked with the collaborative team to address both financial and parenting issues efficiently.

Outcome: The case was fully resolved after only two collaborative meetings, with agreements reached on parenting, equitable distribution, alimony, and child support.

Equitable Distribution and Mortgage Dispute

Representing the husband at trial, we successfully defended against the wife’s claim for additional lump-sum alimony. She argued that she was unaware the mortgage on the marital home had fallen behind despite previously agreeing to retain the property. Through careful preparation and presentation of the evidence, we demonstrated that financial disclosures exchanged during the case provided information that should have alerted her to the mortgage status.

Outcome: The court rejected the wife's request for additional lump-sum alimony and ruled in our client's favor.

Earning Capacity, Imputed Income and Alimony Claim

Representing the husband, we disputed wife’s earning capacity and pursued a vocational evaluation to determine her ability to obtain employment and generate income. After a contested hearing, the court granted our request and appointed a vocational evaluator over the wife's objection, significantly strengthening our client's position regarding the financial issues in the case.

Outcome: The wife ultimately agreed to the imputation of income and waived her claim for alimony.

Child Custody & Child Support

Timesharing and Substance Abuse

Our client, a father concerned about the children's safety due to the mother's history of alcoholism, sought a parenting plan that would allow the children to maintain a relationship with both parents while prioritizing their well-being. We negotiated a detailed step-up parenting plan that included extensive protections designed to ensure mother’s ongoing sobriety and accountability.

Outcome: The final agreement included monitoring, alcohol testing, sobriety requirements, and other safeguards before mother’s timesharing could increase.

Majority Timesharing and Maximum Child Support

At a contested temporary relief hearing, we represented the mother in seeking a temporary parenting plan that provided stability for the children and appropriate financial support while the divorce case was pending. Despite the father's objections, we successfully presented evidence demonstrating that the children's best interests were served by a schedule providing our client with the majority of timesharing and appropriate financial support.

Outcome: The court awarded mother majority timesharing and ordered the father to pay maximum guideline child support.

Custody & Support Modification

Child Support Modification Following Job Loss

Representing the mother, we successfully renegotiated child support and the allocation of children's expenses after she experienced a significant decrease in income due to the loss of her employment. Rather than engaging in costly and time-consuming litigation, we worked with the other party to reach a practical resolution that reflected the family's changed financial circumstances.

Outcome: The parties reached an agreement outside of court reducing the mother's child support obligation and reallocating children's expenses to better align with the parties' current incomes.
